Custodianship
An absent or incapacitated parent can be traumatic for any young person. Custodianship allows parents to preemptively establish court-sanctioned custodians to legally ensure children are in safe hands after life-changing events. The person(s) with custody would legally act as parent(s) for the child(ren) after a precipitating event.
At Inherent Law Group, we make the legal process straightforward and the activation immediate so your children have the custodial care when they need it most. Let’s work together to ensure your kids are taken care of.

When It's Needed
Custodianship is activated when there’s a sudden change in family circumstances. However, legal preparations should be made before life-altering events occur. If any of the following situations could apply to you, then it’s time to set up a Custodianship plan for your child(ren):
- You want to legally secure caregivers in case something happens to you
- A parent is facing lengthy high-risk surgery or long-term recovery
- A parent is planning an extended work trip
- A parent has died without a will or other legal instructions
- A parent is struggling with addiction, mental health or an unsafe living environment
- There is instability in the home and it’s unsure who would make decisions for the children
- Your child requires a legal adult to be listed for school, medical appointments, benefits or travel
These situations and more would necessitate a custodianship be established.
How It's Established
Whether there is an urgent need or future plans, custody is formed by:
- Identifying who will take care of your children
- Formalizing your decision with legal documents
- Filing necessary court documents and family forms
- Ensuring all involved know when to act and what to do
Why It Matters
By establishing custodianship documents in advance, when emergencies occur or crises arise, you will have prevented prolonged court battles, negated custody fights and avoided the government-regulated foster parent system. Most of all, you will have protected the children when they need it most.

Custodianship Benefits
Custodial caregivers are typically previously-known relatives or already-trusted individuals preventing uncertainty or anxiety during difficult transitions.
Custodianship creates court-approved decision-making power so time-sensitive choices can be made for schooling, medical care, daily needs and beyond.
After the transition, court oversight and attorney supervision helps ensure the child’s safety and best interests thus reducing potential misconduct.
Supporting paperwork maintains routine for travel, enrollment, benefits and medical treatments without barriers.
